CONDITIONS OF USE

It is specified beforehand that the present conditions govern the sales, by colette, of all the products available on site colette.fr.
These conditions apply other than all other conditions.

ARTICLE 1 - PRICE

1.1 - The prices of our products are indicated in euros all inclusive of tax except share in the expenses of treatment and sending. These prices are communicated in Euros.

1.2 - In the event of order towards a country other than the Metropolitan France you are the importer of the products concerned. For all the products dispatched except European Union and Dom-Tom, the price will be calculated net of tax automatically on the invoice. Customs duties or other local taxes or right import taxes State are likely to be exigible. These rights and sums do not concern the spring of colette.fr. They will be payable by the customer and raise of its whole responsibility as well in terms for declarations as for payments to the authorities qualified organisms for your country. We advise you to inform you about these aspects near your local authorities.

1.3 - All the orders whatever their origin are payable in Euros.

1.4 - colette.fr reserves the right to modify their prices constantly but the products will be invoices on the basis of tariff in force at the time of the recording of the orders subject to their availability.

Contractual information is presented in French language and will be the subject of a confirmation taking again this contractual information at the latest at the time of the delivery.

ARTICLE 3 - CONFIRMATION

When you click on the "confirm" button my order after the process of order, you state to fully accept this one as well as the entirety of these General Conditions of Sale and without reserve. The data recorded by colette.fr constitute the proof of the whole of the transactions passed through colette.fr and its customers. The data recorded by the system of payment constitute the proof of the financial transactions.

ARTICLE 4 - AVAILABILITY

Our offers of products are proposed within the limit of stocks available. You of the exactitude of your co-ordinates ensure: name, addresses and telephone number. To check at the time of the order, article by article, that the number, the color, the size, the price are well taken into account in your purchase order. When a product is not available any more, this one posts SOLD OUT and it is not possible any more for you to order it. However according to the availability of our suppliers, the product could be again in stock on the site and you will be able if you wish it in being informed by e-mail.

ARTICLE 5 - DELIVERY

If you chose, "pick up at colette store" option, please show up with a print of this email AND YOUR IDENTITY CARD, at colette, 213 rue Saint Honoré, 75001 Paris, Subway Tuileries (M1). Your items will be available 24 hours after your purchase. Your order will be at your disposal for 10 days maximum. colette is open from monday to saturday, 11AM to 7PM. Caution : all the orders done on fridays / saturdays / sundays with the pick up at colette option, will be only available in store on the next monday, at 6 PM.

The products are delivered to the address of delivery you indicated during the process of order. colette.fr is dependent by contract with the Post office and all the sendings will be done via two postal services: Colissimo Simple and Colissimo with Insurrance for France, DHL for the U.E and the rest of the world.
The delivery cost are automatically calculated as soon as you constitute your basket of purchases and appear in the rising final one at the time when you finish your order. When we treat your order and process with the sending of the parcel we will transmit you by e-mail the number corresponding to your parcel. All the custom charges incurred are the responsibility of the customer. In the event of loss or of deterioration of the product during transport, the customer will have to inform the conveyor of it as fast as possible.
The port will be done via the Colissimo service of the Post office and DHL, and you will be able to follow your parcel by typing your number on the following site: www.coliposte.net and www.dhl.com.

In the event of unusual delay, a mail will be addressed to you.

ARTICLE 6 - PAYMENT

All the orders dispatched in France are expressed in Euros all inclusive of tax (19,6% VAT). colette.fr will accept your payment with one of the following bank cards: CB, VISA, MASTERCARD, AMERICAN EXPRESS, DINERS CLUB, and JCB.
Your paiement is securised by Paybox.

If the amount of your order is equal or higher than 400 €, colette.fr will accept payment only by Paypal (www.paypal.fr)

We may ask further information about your identity in order to secure the payment.

ARTICLE 7 - RETURN/EXCHANGE

colette.fr is committed to providing you products of high quality. If you are not satisfied with your order, colette commits itself to exchange or refund you the products concerned. The expenses of sending and return will be then payable by you. You have a 7 days deadline as from the date of reception to return us the products. If you want to return undamaged or complete items, the cost of return will be payable by you. The contents of colette.fr want to be precise, however, no responsibility is assumed by colette. colette is not responsible for the leading and illustrated contents.
Perfume and cosmetic products are not exchangeable or refundable.

Products on sale can not be returned nor exchanged.

Unidentified returns may be returned to the sender.

Perfumes and Beauty products may not be returned nor exchanged.

Broken, incomplete or used products may not be returned nor exchanged, or will be returned to you and the cost of the shipping will be payable by you.

Opened electronic products may not be returned nor exchanged.

Products on sale in the VINTAGE section may not be returned nor exchanged.

ARTICLE 8 - SECURITY

colette.fr uses a secure socket layer (SSL) protocol to protect your information against any leakage or misuse. Credit card transactions are processed via Paybox System.
We adopted the process of encoding SSL but we also reinforced the whole processes of jamming and encoding most effectively to protect, as much as possible, all the significant data related to the means of payment.

All the texts, comments, works, illustrations and images reproduced on the website colette.fr are reserved for the title of the royalty and intellectual document of title worldwide. For this reason and in accordance with the provisions of the Code of the Intellectual Property, only a private use is allowed unless special dispositions are previously made, following the code of the intellectual property. Any other use is constitutive of counterfeit and sanctioned with the Intellectual document of title except preliminary authorization of colette.fr. Any reproduction total or partial of the catalogue of colette.fr is strictly prohibited.

ARTICLE 11 - RESPONSIBILITY

The offered products are in conformity with the French legislation into force. It rests with to you to check near the local authorities the possibilities of import or use of the products or services that your plan to order. The reproduced photographs and texts illustrating the products presented are not contractual. Consequently, the responsibility for colette.fr could not be committed in the event of error in one of these photographs or one of these texts. colette.fr could not be held for person in charge for the inexecution of the contract concluded in the event of unavailability or out-of-stock condition of the product, of cause beyond control, disturbance or all-out strike or partial in particular of the mail service and means of transport and/or communications, flood, fire. colette.fr will not incur any responsibility for all consequential damages because of present, trading loss, loss of profit, loss of chance, damage or expenses. Bonds hypertextes can return towards other sites that site colette.fr. colette.fr releases any responsibility if the contents of these sites would contravene the legal and lawful provisions into force.

ARTICLE 12 - APPLICABLE DUTY - COMPLAINT

This contract is subjected to the French law. The language of this contract is the French language. In the event of complaint, the French courts will be only qualified.

ARTICLE 13 - PERSONAL INFORMATION

colette.fr is committed not revealing with thirds information that you communicate to us. Those are confidential. They will be used by its internal services only for the treatment of your order and that to reinforce and personalize the communication and the offer cultural and produces reserved to the customers of colette.fr, in particular by the newsletters of colette.fr to which you will have subscribed as within the framework of the personalization of the site according to your centers of interests.
However, when you go on colette.fr starting from certain sites partners of colette.fr and identified like such, the data concerning you are likely to be exceptionally communicated to thirds. If you do not wish it, indicate us via the addresses below. Consequently, in accordance with the French data-processing law and freedoms of January 6, 1978, you have a right of access, of correction, and opposition to the personal data concerning yourself.

ARTICLE 14 - DOWNLOADING

Prior to the payment of their order, customers must make sure they have the adequate material to read and download the different files, and verify that their Internet connection is suitable.

After verification of their payment, customers automatically receive the audio files on their computers. The download link remains active from the customers’ account during a period of 5 days.

Refund and period of withdrawal:

Similarly to the purchase of other products via downloading platforms, no refund can be authorized once the payment has been authorized.

The refund requests from customers who have changed their mind prior to the download beginning will not be taken into account due to the impossibility to verify if a customer succeeded or failed to download a file.

In case of the customers did not receive an email with the downloading links, they can contact the colette customer service at eshop@colette.fr in the 6 months following their order.

We recommend that customers proceed to backup copies of their downloaded files in the event of a computer data loss.
